Legally, you can enforce a verbal contract that has a deposit.

If you really want Climax, you get a lawyer to draft a letter to Kyle.

But pragmatically, let it go. Lawyers are pretty useless even if you're in the right.

And in general, buying used stuff from somebody with poor morals isn't really a good idea.I'd put this issue on all the popular boards though. Paybacks are a girl dog...:lildevil:

Agree 100% ^^ Sorry to here you got the shaft, I have been there before and it really sucks.. As previously stated keep yours eyes out for another deal there seems to be more and more people getting out of the sport recently..

When I talked to Visa it hadn't been credited but she says it takes a few day to show up.

To be on the safe side I would depute the charge now with credit card company stating you have been defrauded so you have it on file. Since they will have to send you paper work to fill out anyway to sign.

Oh I posted it everywhere I'm a member. Thanks for the advice, I actually called my lawyer but he hasn't called me back. I will ask his opinion. I'll probably just let it go but we shall see.

Ya who knows perhaps you got lucky and didn't end up with it. If he's into shady business practices whats to say he represented it properly. Now after the fact what makes you think he is the least bit honest?

Consider yourself lucky and walk away. Just depute the CC purchase as stated. Before he pays a supplier or buys parts for his new venture!

Ya he pulled a lot of crap on the DP years ago.Flying under the vendor radar. Always came off as a smart ass but I don't know him from Jack purely speculation.

Nonetheless bad publicity is just that, bad. Might bite him a little but I'm sure he has his side of the story to tell. They always do

More than likely someone he knows came up with the cash and he said screw the original guy. Piss poor excuse but like everything it eventually fades away.

Everything does fade away I agree. My wife said just to forget about it but there was no way I could. I was warned about him but I decided to make my own judgement.

You think thats bad?

This happened to me twice at dealerships looking for my truck. One of them was almost 250 miles away.

I called in the morning on their website listing. They said they had it there and that i could come whenever.

When i got there i asked to see the internet fleet manager who i had talked to on the phone.

He sold the truck 3 days earlier and tried to sell me an extended cab 2500 gasser.

I can't even begin to explain how heated I was.
