wastegate stuck help!!!!

If I understand the operation correctly it should be closed...it should only open when the desired amount of boost is reached, therefore relieving the pressure.
do u know if the actuator pushes or pulls. its stuck and i dont know which way it is suppose to go
The wastegate is closed untill the desired amount of boost is reached. then the acuator extends and pushes open a door to allow gases to flow around.
On edit: you can take the little hose off that leads to the top of wastegate and hook up a compressor (regulated ~30 psi should do it), apply pressure, and see if it extends or not.
also, you might have a boost leak elsewhere... check the tubes before and after the intercooler.

This does'nt sound like a gate problem. Check and make sure you dont have an air leak between the airbox and the turbo. My resonator came off my intake causing an air leak once on my 03 and it ran exactly like you describe.
