Hmm I'll have to look into it. But ours would be: we don't collect shit and so we can't do anything with it.
While Pat, Kat and I live in California and are affected the blog is incorrect in saying "....or website owner offering a website for use/viewing to residents of California" you might be affected. If I lived anywhere else I could tell them to jam it. The server is not in Ca. so they would have no authority over me then. The European Union has a number of laws about forums but I don't have to follow them. This law will only affect people that live here or if their servers are here. How does California expect to enforce this all over the world?

Thanks Mike. Funny thing is there is no talk about this on any of the admin sites and even vBulletin that is HQ'd in California doesn't have anything. The only talk is on some law blogs like the one linked above. And all of them are trying to say that everyone everywhere has to follow California law. These law people must not realize that California is not the Federal Govt. and can't dictate law to residence of other states or countries. :rofl:
No prob. The law has always been there awhile, however 2 changes were made and thats what this is all about. Hope this sheds some light.

I am the author of the blog you have linked and I wrote the post as well. I found this thread after searching for my blog on Google. I didn't quite mean for it to be written like it has been thought of here. California did indeed pass a law which can be read about at http://www.casro.org/news/152489/California-Expands-Online-Privacy-Law-.htm
It doesn't just apply to message forums, it applies to any website that collects information. This site required me to register and it uses cookies, so yes it collects information as do most message forums.
Now you got a point, if you don't live in Cali or your server isn't located there, maybe you have nothing to worry about but then we look at UK's law - its for the entire United Kingdom, what is to say that won't eventually happen for the entire US? That was mainly my point... You should have a privacy policy if you collect information to begin with, adding one now, even if you don't have to by law, isn't going to cause harm. It will protect ahead of time in the future when other states pass that law and they probably will.

Thanks for the info Shawn. I'll add one when I get time. Since I live in Cali. I have no choice. I still find it funny though that many that have written about the law say 'since the internet is border less' every site everywhere has to follow the law whether the owners and site are not in California or not. But what do I know.

However with the internet and the problems of today, especially in terms of privacy - people are always sueing corporations and even small businesses because they have violated their privacy in some way, shape or form. I think privacy laws have a good idea in their development but its mainly just a "please don't sue me" tactic for many of us website owners anymore, these days.
Adding a privacy policy among other policies is often one of the first things I do when I start a new forum, blog or whatever website I decide to start that week (I'm a website addict, haha). It was a pain in the rump at first but now I am as used to it as I am used to marketing the website.
