My mother in law had a birthday on the first. So we all put some cash together and got her a nintendo wii and some games.... We spend monday playing wii all day and had a blast. So my wife says lets get one - i have a ps3, we don't need a wii. I quickly changed my mind and we went looking for one. Could not find one after going to several places. This afternoon i head over to a games for less. I'm late for dinner so i had to make it quick. I ask if they had a wii they said yes, ask if they have a wii fit, they say yes. I said bag it up lets do it. I toss down $350 cash and tell them to put the rest on my atm card (wamu). They tell me to inspect the wii fit because once it leaves the store i cannot return it even if it is broken - need to call nintendo. K, thats weird but i said whatever.... guy looks at me as the receipt is printing and tells me, k the total was 474 and i went what??? The owner then takes the receipt and stamps FINAL SALE on it and hands it to me. I told them no, the wiis are 249 and the fits are 90. Final sale , no returns he tells me. I didn't know what to say so i continued on for a bit then felt basicly i was ****ed so i grabbed my overpriced goods and went to dinner.

Buddy of mine wanted to go to best buy so i'm like cool, i'll go. They had 5 wiis and 10 wii fits. GO FIGURE !!!

So, is there anything i can do? I inputed my pin number for $124 charge. I know i should have checked the price first but come on - who would have expected a $50 mark up on each item?

gonna go to wamu tomorrow and dispute the charge. BBB is on the list too... Unfortunatly games for less is not a corporate company (googled them for past hour).

i wanna just call it a day - crack open the boxes and play some boxing or something but i'm afraid if i open the goods i have no chance of returning....

Really, they have them at walmart all the time about 2 miles from my house:confused:

About 3 weeks ago they had 4 of them and I was gonna buy them all and sell them on e-bay, but I figured that they must be easy now to get ahold of since they had 4 sitting there......maybe I should have got them:confused::mad:

I had the pleasure of getting my fiancee one a few months ago and just got her a fit a few weeks ago haha

That sucks!

I most likely would have tossed the Wii through the store windows. Or gone to my truck to get my breaker bar and politely asked for a refund.;)

You might as well piss into the wind as far as calling the BBB. They are worthless in my experience.

I think your bank would be the best bet.

just an update.... i talked with the bank and they were no help. Gave me another number i could call and was transferred several times... i said fuggit.

I own a very expensive wii, whatevers.... Basicly it's my fault, had i not been in such a hurry and making assumptions - we would be alright. I have a working wii - it's cool for a little while alone but it's more fun with people over.

It's no match for the ps3 - i'm not a hardcore gamer, i just like the nice graphics with the car games. Oh, and i enjoy killing people. :)

Check out your states laws. Most states have laws that you can return things even if it says all sales are final, as long as it wasnt from a private party. I did a semester in criminal justice and had some law classes. Even restocking fees are bogus if its within 30 days. Most people don't bother fighting it because they don't know they really don't have to pay them. But it can be a real PITA to get the state involved so you don't have to pay a restocking fee.

Consumers
REFUND POLICIES

Consumers have come to expect stores or catalog companies to offer a refund, credit or exchange when they return items. Sellers are not required by law to accept returned items unless they are defective. However, California law requires that retailers who have a policy of not providing a cash refund, credit or exchange when an item is returned with proof of purchase within 7 days of purchase must inform consumers about their refund policies by conspicuously placing a written notice about their policies, in language that consumers can understand, so that it can be easily seen and read. Some companies may limit exchanges or returns for credit or refunds on all, or some products. Some may not allow exchanges or returns for credit or refunds at all. But whatever the limitation, it must be conspicuously disclosed. Before making a purchase, carefully check the store's policy.

The policy must be displayed either at each entrance to the store, at each cash register and sales counter, on tags attached to each item, or on the company's order forms, if any. A return policy printed only on a receipt, for example, is not sufficient.

If a store violates this law (California Civil Code section 1723), the purchaser can return an item for a full refund within 30 days of purchase.

There are exceptions, however to the general rule requiring notice. Notices are not required for sale of perishable goods like food or plants; for items marked, "All sales final," or something similar; for items which are used or damaged; for items customized for the consumer and received as ordered; for items which cannot be resold for health reasons; or for items not returned in their original packaging.

Some stores keep records of consumers who frequently return merchandise and sometimes report that to a central reporting company and may not offer returns or refunds to such customers. The return policy notice must refer to such practice.

Consumers who believe a retailer has violated the law can notify the consumer protection division of their local district attorney's office or by filing a complaint with the Attorney General's Office.
