Help: Help! Apartment legal advice...

Alright this is going to get long but I feel like I'm in the right. Anyone with legal knowledge in Texas on topic please chime in.

My wife, 9 month old, and I have been at this apartment for almost a year now. They have recently started full renovations on buildings but didn't think much about it for first couple weeks because they were at other building and no notice of anything upcoming. Now where shit completely falls off...

Came home last last Friday (the 18th) to men in our apartment (unlocked our door and came in while we were gone, no notice) by the time I got home they already had our AC out and our dishwasher... I flipped, kicked everyone out, had my son in my hands so didn't get out of control. Called apartment management and they said the contractor put their schedule on a temps desk who has been gone and then just started going in. Management said corporate hired them so she can't do anything about it and corporate never answers. Went all weekend with no AC (been warm in TX)

Last week we got a notice Monday that they would be doing our hot water heater. Got the notice at about 6pm that they would be coming in at 8am. Guess that counts as 24hr notice. Only notice we got, came back Wed and Thurs to people inside doing random shit. It's gotten stupid out of hand to the point where this week they are redoing our floors because I asked my neighbors. We can either move our stuff around or they will for us.

Apartment management says to address issues with the construction supervisor, supervisor thinks he is God. The nice for the last 2 weeks in our building has greatly effected my son's sleep. We have found nails and screws in carpets while he is playing around. Would someone help me with what I am in my rights to do. Thanks you very much for reading.

They are VERY much violating the tenate laws you are entitled too. you need to take it up with the front office, if they dont take care of it, get ahold of corporate, if that dont work you either go to court or plan on moving as they have violated the contract you filed and you are no longer bound to it.

I bet you are missing money, a few TVs, about 15 turbos and a fully built motor from your apartment after they let themselves in. You better make sure its all there ;):rofl:

Do you have a lease? Your only recourse with the apartment is to move as long as you can establish reasoning to get out of the lease. Looks like you have reason


Nothing was posted in a community area? If your aware of safety issues (nails screws etc) and you put management on notice that means that your aware of the problem and need to take reasonable care to insure you or your child does NOT gets injured.

Sucks but I'll bet you wont get moving expenses or anything. It'll be put up or move and if you show legit reasons if the management should come after you for the balance of the lease you should get away scott free. Sounds like you do (safety) but I'm no lawyer. Unless you can stay with someone until they are done?

oh they may. make sure you document everything, keep notes, and get all you can in writing.

make sure you give as much notice as possible and your security deposit they are probably going to keep.I wouldnt stand for it id be gone.Also send letters to the management and to corprate about how you were treated,include dates and times and who you talked to,the power of the pen can be amazing at times.

Call the local news. In San Antonio we had a news segment called what's driving u cray they would go and do investigations and stuff always got fixed.

lawyer can help you the problem is big companys dont care about you or your family.YOU HAVE MORE RIGHTS AS THE TENANT THEN THE OWNER! Trust me that why I dont rent my studio any more

I would let the front desk know if they can't address your concerns immediately, they'll be contact by your attorney. See if that gets them to contact the corporate office. Also keep really good records of the names and positions for the complexes staff that keep telling you they can't help. It always helps to make a point of asking for a full name and job title, nothing gets people motivated like thinking they may be blamed for not doing their job!

X2 for take pictures. Write a letter and make copies. Call the cops to get a written report of the incident then move. Honestly, hurt them where it counts, right in their pocketbook. That will deliver the loudest message. But def file complaints with managers name and temps whoever. Make trouble for those people's jobs then move out to a better facility. If the workers are rude or disrespectful, file a complaint with BBB or Angieslist after you find out the private contractors name who was subbed the work.

I know in Ca, the landlord must give 24 hour notice that he/she is gonna enter the premise. I would assume the same for all states. I would search for the landlord tenant laws on your state.

Lease has an implied covenant that Tenant has right to quiet and peaceful enjoyment. Just lived thru this with lady that works for me.
All communication in writing, preferably certified mail, call the local news (huge motivator for landlord), contact Texas Attorney Generals office (Abbott's about to run for Governor and should be attentive to this problem which is prevalent everywhere).
