apartment 30 day notice

So i just got a job finally down in phoenix this past weekend and teh GF and i went out apartment hunting. We wound up finding a great place this past sunday and signed up for. Well, i put my 30 day notice in with my apartment complex im in in flagstaff on march 1st (yesterday). They will not give me my 30 days untill the start of april cause they say "since it is the begining of a new month it, you would have had to put in you 30 days on the 28th to count for this month". Well they are closed on the weekends so i couldnt have dropped it off when i got back up that night.

So i guess what im wonderin since im already tight for money is, since they were closed on the end of the month should they have givin me a one day grace period meaning when i turned in my 30 day notice yesterday it should have counted for this month or was the friday before the 28th really the end of the month for the apartment complex?

Ill be leaving in two weeks for good and really dont wanna pay for another month at the apartment complex up here when i wont even be there! I need to dig out my apartment lease and see what it says as far as when i could turn in my 30 days if the office was closed on the last day of the month but hell id figure they'd give you a one day grace period! What do you guys think? anyone been in this situation before? 700 for the new apartment plus 545 for my old one in one month is all i would be able to afford when april comes due so i wouldnt be able to buy any food or anything for a month if i had to do this..:(

haha you could maybe fit 10 people in this little studio up here. This shit jsut keeps stressin me and im tired of having to keep worring about makin rent or payments. I know other out there are less fortunate than i but it jsut wears on ya. I jsut wanna get started at the new job now!

Just mention that they will be receiving a call from your attorney. That usually changes a lot of minds.

Before you do that, look over the lease again. They may have you by the balls.

Check online for AZ to see what the laws are. My nephew had problems with a place he moved out of in Ca. He looked online and copied a bunch of it into a letter he gave the rental place. They shut up and give him his deposit and left him alone.

Uh, isn't 30 days 30 days? :confused: Seems to me it shouldn't matter when you give the notice that you're terminating your lease in 30 days....

X2, 30 days is 30 days. Also does your lease have a grace period (as in rents due on 1st, but by the 5th)...They have to pro rate it somehow, they cant charge you a full months rent with you only being there 1-3 days.

Also got email/pm, you will have a email coming..

well the lease states that my 30 days has to be in by the end of the month prior to the month i put for my 30 days. They will not accept my 30 days at the 1st of the month in which want as my 30 days. So i would have had to turn it in on th 26th to be able to use the 30 days for this month but since it was on the 1st it will only work for April. everything i have read though does not state that if teh office is closed on the last day of the month that i have to give them the 30 days on the prior work day. It only states about the 1st being too late to put in your 30 days for the same month. So i would assume that they would give a one day grace period but they said no.

I guess im not sure what to get together to go in and prove that my 30 days should start this month. Im in that gray area it seems and dunno where to go about it. I guess i need to get to readin all the tenant laws and see what i can come up with. Guess these guys really need money :mad: Anyone got someone i could talk to about this? reading only does so much and it seems that even laws have grey areas that i dont get

C. You Must Give Proper Notice Before Moving.
If you have a month-to-month rental agreement, you must give the landlord written notice
(Form K) of your intention to move at least thirty (30) days before the rental due date. If you have
a week-to-week rental agreement, a ten (10) day notice is required (A.R.S. § 33-1375).
You should request a walk-through inspection of the dwelling with the landlord present
before you move. You may wish to use the same inspection checklist that you used for moving in
to compare the condition of the dwelling. If you move before your lease expires, you are legally
liable for payment of the remainder of the lease unless the landlord re-rents the property. If the
landlord does rent to another tenant, you will only owe for the period after you moved out until the
new tenant moved in.
Be sure to return your keys or make other arrangements for getting the keys to the landlord
on the day you vacate the dwelling. This will help prove that you are out of the dwelling on that day,
and prevents any claim being made against your security deposit for more rent or for the cost of
keys.
When you move out, take all your possessions with you. However, the landlord is obligated
to keep anything you leave for twenty-one (21) days (except trash), before selling it or throwing it
away. You will be required to pay for moving and storage costs (not cheap) to get them back.
REMEMBER to leave the dwelling in the same condition as you rented it. Damages or
failure to clean the dwelling may result in the loss of your deposits and could even result in the
landlord filing a lawsuit against you for excess damage.

It says 30 days from rental due date.

right so im pretty much screwed. i was reading that and alos found some threads of some guys who had the same issue. guess ill have a nothern apartment till the april... :(

Always remember. People naturally dislike confrontation. Theres no almighty rule here and remember that the people sitting in that office have the power to change whatever they want.

oh trust me, i know but she is a royal bitch and i thnik she likes the whole gettin in your face thing. Tried it before this mornin and boy was i runnin out with my tail between my legs. now this isnt to say i easily back down from a fight but she knows her stuff and was very quick to explain the law and there aint no way around it. there aint no workin with her thats for sure.

the way i look at it, i should have read/figured out the 30 day notice deal two weeks ago when i thought i was gettin another job. big mistake on my part but you learn and ill just have to deal with it.

So steve, when your done with that turbo i got a place for us to stay and go snowboardin up here in flag! lol and yeah i know about your cabin or should i say house by sunrise :D
