I live in a subdivision with a HOA :rolleyes:.

They do not allow us to park on the street. My truck dont fit in the garage.
My driveway is not long enough for my truck. Only solution is to park 1/8+ mile away from my house....

there is 2rarely used spots right by my house for guests....if there used, it is 99% only 1 spot at a time.

heres is the letter I wrote:
To the Serenity Home Owners Association, and Homeowners:


I am addressing a parking problem within our subdivision. The problem I have is with the handicap parking by the pool. The parking is not an actual legal handicap sized spot. It is not big enough to allow room for me to get my wheelchair out of my truck. I usually find a way to make it work; sometimes parking on the curb a bit so there is room between my truck and the adjacent car.

The other issue is that I have to push myself in my wheelchair about an eighth mile to my house from there. That’s quite a long distance when its late, cold, raining, or carrying belongings and such.

My idea is to change one of the ‘rarely’ used guest spots at the west end of Hedge Creek Ave. into a handicap parking spot. While it is not a legal sized spot, it doesn’t allow for another car to park too close to me, which gives me the room to get my chair out. I have once been late to work just waiting for one of the cars that parked next to me to leave so I can even get in my truck. The guest spot would not require any serious changes; it does not even have to be marked handicapped. I’d rather not park on the street and violate the rules of the HOA, however I would like to be met somewhere in the middle on this topic. A “no” or “sorry” simply is not what I am after. I would assume this idea would be valid or someone would have some sort of idea or suggestion. Many home owners see me making the trek to my truck and ask why I can’t just park down there, so I don’t really see where an issue would arise. I have not sought legal advice at this time. I am asking for a fair solution from the homeowners and the HOA.

Hmm, thats some :bs: Mike:mad: I'd be pissed myself, if i were in a wheelchair and be forced to do as you, thats not fair on your behalf! Hope they make it right:hug:

I would think you'd have rights via the Americans with Disabilities Act that would trump any HOA rules.

I take it theres no way to pour a larger driveway next to the garage?

I could never understand HOAs. I'd never live in a place where someone else has the power to tell me how how I can use my property. Just my opinion....

no, walkways between houses to front door. My driveway is about 6' long :rofl:

truck fits in garage but sticks out 4 inches when touching back wall. Which some late nights I back in and leave garage door open. then get a letter saying I left my door open and violate that rule because its unsafe :rolleyes:

Yowch. Too bad you cant extend the garage another couple feet.

The Fair Housing Act makes it against the law to deny persons with disabilities reasonable accommodations or the right to make reasonable modifications to a dwelling when the accommodations or modifications are needed for them to fully enjoy their homes.

Also this:
Homeowners' associations are required by the Fair Housing Act to allow reasonable modifications to housing, such as the installation of a ramp, paid for by an occupant with disabilities so that a occupant with a disability may use and enjoy the premises. They are also required to make reasonable accommodations in rules, such as those governing parking, to enable an occupant with disabilities to use and enjoy the dwelling.

never realized you were in a chair... learned all kinds of things today (also just realized juddski's truck in avatar and sig isn't his. :eek: )... been a good day tater.


on a more relevant note, I have a friend who is also in a chair and HEAVILY into the diesels... he has a dodge pulling truck and LMM EC SB daily driver. He can pull himself into the seat and then fold up his chair and put it behind his seat in the extra cab... no lift. His paralized from a little about the waste down. Still rides tractors and everything... many probably know who I'm talking about. He's on most of the boards... Teddy Bear. Has the flaming head guy in wheel chair on his ec window on his Dodge pulling truck. One of the coolest guys I've had a pleasure getting to know!



Good luck getting a better parking situation. That really is the least they can do IMO.

ADA mike. no ramp at your front door no parking. you kitchen counter is to high ect ect just make a list. and submit it to the hoa ADA laws have alot of pull. And IM sure they wont have issue re doing that spot for you.

As all said above, ADA...

The HOA has a legal obligation to provide you with a suitable parking spot. If they don't respond nicely to your letter, push hard.

ADA laws are not something to be overlooked; your HOA can get in big $$ trouble.

Mike,

This is a serious issue and you have every right to suitable and reasonable parking due to your circumstances. The ADA has your back in situations like this, and you should follow up with a letter stating ADA laws. This should push them into doing it faster, as it shows you have done your homework.

If that doesn't work, I know an attorney or two to send you too.

I can vouch for this problem. Everytime Im over at Mike's place, I always park illegally and then scramble everytime we hear something that sounds remotely like a tow truck. It is a load of BS to put all the parking spots for owners/renters so far away from their residence. I think that letters good enough. Not being a hardass but you are getting their attention. Like Chad said, if they dont react, then call ADA. You know they'll be more than happy to jump on that problem.
