Mine has been fairly flawless.... I got it when it was first released and have not yet had to do a factory reset. The biggest improvement thus far has been battery life. My Evo 4G would be dead after 3 hours of my usage whereas this phone goes all day! Have you considered rooting??? I did on mine. (Lets you get rid of useless factory apps that drain battery life and lets you use the WiFi tether for free)

are you running a different rom or kernal in it?

Is rooting easy?

if its as easy as the older ones, even you can do it in under a month :D. just make sure you un root it if you have issue and need to bring it back to your provider.

Still running the stock ROM and Kernal as they are going to be more stable than anything else. Havent looked into any of the new ROM's since I did it so I may have to look into it. I did mine on day one as I am appauled that Sprint feels they can charge for a feature that the phone has built into it as part of a hardware spec of the phone that you are already purchasing.
I was running the Nitrous ROM on my old 4G and that worked great.

oh nice! i completely agree on them trying to charge for the damn wifi. Ive got the old 4g running on cyanoid7. its pretty bad when those ROMs are more stable than the factory ROM. Alteast they got the new one figured out. My contract is up in two weeks so ive been lookin at what i want to upgrade to

Yes, rooting these is even easier than the older ones. Theres a program you download from Android or XDA developers to your PC that basically runs a script and walks you through the whole process. Its pretty simple. One thing though, on these new phones Android has come to the realization that no matter what people are going to root them so what they have done is made it to where once you root your phone it leaves a "watermark" so that if you end up screwing something up you can no longer just return it to stock and try to claim a warranty issue. You can always return it to the factory state but Sprint will know that it was once rooted and could potentially turn you away for a broken phone due to software issues. Just keep that in mind.
Last, if you do decide to root, I recomend using the program "Wifi Tether for root users" for tethering as its pretty solid.

I highly recomend the 4G LTE (even though there is almost ZERO coverage for the LTE yet). Something nice about these also is that the software now automaticaly recognizes to switch from 3G to 4G in a 4G area BUT..... The phone isnt backwards compatible with standard 4G so you wont get to utilize the increase in speed until LTE comes to your market.

By the way, make sure to keep those damn thieves away! Did you ever figure out if that TomTom is the same?

Well I hope you get the bastard!
Just my advice... Dont pressure him as this would tip him off that something isnt right. I would say wait a day before trying to contact him again. Also, dont ask questions that pertain to any problems that where with your unit as again this may tip him off.
